Amends TCA Title 2, Chapter 12.

Present law requires municipalities and counties to furnish legal counsel to a defendant county election commissioner for a proceeding involving a municipal or county election. The counsel furnished is that chosen by the election commission. With exceptions, present law also requires a county to fund the operations of its election commission. <br /> <br /> This bill adds that:<br /> <br /> (1) If the commission carries an insurance policy providing coverage of claims asserted in a lawsuit, the provisions of the insurance policy will control with respect to representation of the commission; and<br /> (2) If the county carries an insurance policy for the county election commission, its employees, or its election officials, the election commission must comply with the terms of the insurance policy with respect to expenses covered by the policy.<br /> <br />
