Amends TCA Title 68, Chapter 221, Part 4.
ON MARCH 4, 2019, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 178, AS AMENDED.

AMENDMENT #1 rewrites this bill. This amendment prohibits the commissioner of environment and conservation from denying a permit for a septic system solely because a public sewer system is accessible if:

(1) The department of environment and conservation or a local government has placed a moratorium on additional connections to the public sewer system; and
(2) The applicant submits documentation with the application for a permit that the applicant cannot connect, or has been delayed from connecting, to the public sewer system because of the moratorium.

This amendment specifies that being placed on a wait list due to a moratorium on sewer hook-ups constitutes delay. This amendment also requires that for residential real estate sales involving property consisting of one to four residential units, the potential future obligation to connect to the public sewer system must be disclosed by the seller to the purchaser in the same manner as, and subject to the same remedies, as other known defects under present law.
