Under present law, a local school board is the sole authority in appointing a director of schools. A board may employ a director under a written contract of up to four years' duration, which may be renewed.

This bill authorizes any county or city operating a school system to require, by a two-thirds vote of the county or city governing body, the director of schools to face a retention election at the next regular August election immediately preceding the expiration of the director of schools' contract. If authorized by the county or city governing body, the county election commission must place the named director of schools on the ballot as a yes or no retention question. If a majority vote against retaining the named person as director of schools, then the local board of education will not extend a contract or term of a director of schools.
