Amends TCA Title 40, Chapter 39.
Under present law, a registered sexual offender or violent sexual offender is prohibited from:

(1) Establishing a primary or secondary residence within 1,000 feet of the property line of any public school, private or parochial school, licensed day care center, other child care facility, public park, playground, recreation center, or public athletic field available for use by the general public; and
(2) Residing within 1,000 feet of the property line on which the offender's former victims or the victims' immediate family members reside.

This bill increases the boundary in the above-described provisions from 1,000 feet to 2,000 feet.

Present law prohibits registered offenders from residing with a minor if the offender's victim was a minor. However this prohibition does not apply if the offender is a parent of the minor, unless one of the following applies:

(1) The offender's parental rights have been or are in the process of being terminated;
(2) Any minor or adult child of the offender was a victim of a sexual offense committed by the offender.

This bill additionally prohibits a registered offender from conducting an overnight visit at a residence in which a minor resides or is present if the offender's victim was a minor. Like present law, this prohibition will not apply if the offender is the parent of the minor.

This bill adds to the two provisions (described above) whereby an offender is prohibited from residing or staying overnight with the offender's child the fact that the offender has been convicted of a sexual offense or violent sexual offense and the victim was a child under 12 years of age.

ON APRIL 30, 2019, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 425, AS AMENDED.

AMENDMENT #1 deletes this bill's provisions that would increase the boundary limits described in the bill summary from 1,000 feet to 2,000 feet.
