Amends TCA Title 4, Chapter 29, Part 2; Title 4, Chapter 3, Part 22 and Title 4, Chapter 3, Part 54.
ON MARCH 18, 2019, THE SENATE ADOPTED AMENDMENT #2 AND PASSED SENATE BILL 642, AS AMENDED.

AMENDMENT #2 rewrites this bill to vacate and restructure the Tennessee sports hall of fame board of directors on the date that this bill becomes a law.

Under present law, the board consists of 25 members, including eight gubernatorial appointees, eight members appointed by the lieutenant governor, eight members appointed by the speaker of the house of representatives and the commissioner of tourist development or the commissioner's designee. The new board will consist of 19 members, including six gubernatorial appointees, six members appointed by the lieutenant governor, six members appointed by the speaker of the house of representatives and the commissioner of tourist development.

Members of the present board are ineligible for appointment to the new board.

Present law requires that no more than eight appointed board members reside in the same grand division, but does not divide this responsibility among the appointing authorities. This amendment requires the appointing authorities to each appoint two members per grand division.

Under present law, board members serve six-year terms and directors may be reappointed an unspecified number of times. This amendment staggers the terms of the initial appointees to the reconstituted board and sets the terms of subsequent appointees to the reconstituted board at four years. This amendment limits board members to serving no more than two consecutive terms.

This amendment makes various changes to the board's procedures, such as increasing the minimum number of annual board meetings from one to two, changing the title of the presiding officer of the board from president to chair, requiring the board to select an executive committee from its membership, and specifying that the board's meetings must be open to the public and the board's records are subject to public inspection.

Present law authorizes the board to hire personnel, including an executive director. Under this amendment, the board will continue to have the authority to hire personnel. However, any current employees of the board will have their positions vacated on the date that this bill becomes a law. Any employees that the board hires in the future will serve at the pleasure of the commissioner of tourist development.

Present law provides that board members are not compensated for their service. This amendment adds that board members are not eligible for travel reimbursement.

Under present law, the board is responsible for the administration of the Tennessee sports hall of fame. Present law authorizes the hall of fame to adopt a charter and bylaws, and promulgate rules. This amendment transfers responsibility for the administration of the hall of fame from the board to the commissioner and limits the board's functions to nominating candidates for inclusion in the hall of fame, fundraising, and providing advice to the commissioner.

This amendment requires the reconstituted board to reconsider the 2018 and 2019 hall of fame classes within 30 days of the last member's appointment.
