Amends TCA Title 4; Title 9; Title 12; Title 50 and Title 67.

This bill requires an employer to notify the commissioner of labor and workforce development at least 60 days before relocating from this state to a foreign country either: a call center; or one or more facilities or operating units within a call center comprising at least 30 percent of the call center's total volume when measured against the previous 12-month average call volume of operations or substantially similar operations. This bill requires the commissioner to: (1) Compile a semiannual list of all employers that relocate as described above; and (2) Distribute the list to all agencies under the jurisdiction of the department of labor and workforce development, the department of economic and community development, and the department of revenue. Under this bill, an employer that appears on the list is ineligible for any direct or indirect state grant, state-guaranteed loan, or tax credit or refund for five years after the date the list is published. An employer on the list must also remit the unamortized value of any grant, guaranteed loan, tax benefit, or any other governmental support it has previously received from this state to the commissioner. The commissioner, in consultation with the applicable agency providing a loan or grant, may waive the ineligibility requirement if the employer demonstrates that a lack of such loan or grant would either result in substantial job loss in this state or harm the environment. This bill applies to any business entity that employs, for the purpose of customer service or back-office operations: (1) 50 or more full-time employees; or (2) 50 or more employees who in the aggregate work at least 1,500 hours per week, exclusive of overtime hours. This bill authorizes the department of labor and workforce development to promulgate rules to effectuate the purposes of this bill. This bill will take effect January 1, 2022. NOTE: It appears that the reference in SECTION 5(a) to "(b)" should be "(c)".
