Amends TCA Title 8, Chapter 21, Part 4 and Title 36, Chapter 5.

Upon application of either party to a child support order, present law requires the court to decree an increase or decrease of support when there is a significant variance between the child support guidelines and the amount of support currently ordered, unless the variance resulted from a previously court-ordered deviation from the guidelines and the circumstances that caused the deviation have not changed.<br /> <br /> Present law requires that the significant variance established by the department of human services pursuant to the child support guidelines provide a lower threshold for modification of child support orders for persons with a low income according to the guidelines. The significant variance involving low income persons shall be established by rule of the department at no more than 7.5 percent of the difference between the current child support order and the amount of the proposed child support order. This bill deletes the present law requirement that the department's significant variance provide a lower threshold for modification for persons with low incomes.<br /> <br /> This bill adds authorization for the department of human services to review and seek an adjustment to the support obligation to the extent required by the child support guidelines when the department becomes aware of a change in circumstances of either party to a Title IV-D child support case. Under present law, the department is only authorized to conduct the reviews upon request of a parent or custodian of a child.<br />
