Amends TCA Title 9; Title 29, Chapter 13; Title 39 and Title 40.

This bill expands the expenses for which, under present law, a crime victim or claimant meeting eligibility requirements may receive reimbursement from the criminal injuries compensation fund to include the following:<br /> <br /> (A) Expenses actually and reasonably incurred as the result of the victim traveling to and from medical appointments directly related to an offense committed against the victim; and<br /> <br /> (B) Reasonable living expenses, including rent, food, and utilities, incurred by the victim for a period of no more than two (2) months while recovering from injuries sustained as a direct result of an assault committed upon the victim. <br /> <br /> Under present law, the payment of compensation under the Criminal Injuries Compensation Act is awarded for:<br /> <br /> (1) Expenses actually and reasonably incurred as a result of the personal injury or death of the victim, including, but not limited to, actual expenditures of moneys for or indebtedness resulting from medical services, hospital services, funeral and burial expenses;<br /> <br /> (2) Permanent partial disability or permanent total disability;<br /> <br /> (3) With certain limitations, expenses actually and reasonably incurred as the result of the claimant traveling to and from the trial of the defendant, regardless of whether the claimant is called as a witness, and expenses actually and reasonably incurred as the result of the claimant traveling to and from appellate, post-conviction or habeas corpus proceedings resulting from the trial of a defendant; <br /> <br /> (4) Reasonable out-of-pocket expenses incurred for cleaning supplies, equipment rental and labor needed to clean the scene of a homicide, sexual assault or aggravated assault, if the scene was the residence of the victim or a relative of the victim;<br /> <br /> (5) Pecuniary loss to the dependents of a deceased victim;<br /> <br /> (6) Any other pecuniary loss, including lost wages resulting from the personal injury or death of the victim that is determined to be reasonable;<br /> <br /> (7) The victim's reasonable moving expenses, storage fees and fees for transfer of utility service if the move is a direct result of an assault committed upon such victim at the victim's residence; and<br /> <br /> (8) Reasonable costs of cleaning, repairing or replacing eyeglasses and hearing aids owned by the victim that were damaged or destroyed by the crime or the processing of the crime scene, and the reasonable costs of repairing or replacing personal property owned by the victim or a relative of the victim that was damaged or destroyed in processing the scene of a homicide, sexual assault or aggravated assault if the scene was the residence of the victim or the relative of the victim who owned the property.<br />
