Amends TCA Title 39 and Title 40.
This bill requires a court to grant judicial diversion for possession of less than one ounce of marijuana, regardless of a defendant's prior criminal convictions. Generally under present law, two of the conditions a defendant has to meet in order to be eligible for judicial diversion are to have no prior convictions for a felony or a Class A misdemeanor and not previously have been granted judicial diversion or pretrial diversion. This bill removes those conditions when the offense for which deferral of further proceedings is sought is possession of less than one ounce of marijuana.
