Amends TCA Title 38, Chapter 8 and Title 55, Chapter 10, Part 4.
ON APRIL 5, 2021, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 399, AS AMENDED. AMENDMENT #1 rewrites the bill to require that the course of training leading to the basic certificate of compliance issued by the Tennessee peace officer standards and training commission include a course of instruction in the detection and investigation of cases of suspected driving under the influence. This amendment requires that relevant changes or updates in law and procedure related to the detection and investigation of such cases be provided during required annual in-service training. This amendment will take effect January 1, 2022. ON FEBRUARY 14, 2022, THE HOUSE SUBSTITUTED SENATE BILL 399 FOR HOUSE BILL 328, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 399, AS AMENDED. AMENDMENT #1 rewrites this bill to require each law enforcement officer specifically assigned to the traffic division of a local law enforcement agency or its equivalent, or for whom a county sheriff or chief of police deems it necessary, to undergo training on the proper testing procedures for use in investigating cases of suspected driving under the influence. For certifications completed on or after January 1, 2023, the training required by this amendment must be completed as part of the required annual in-service training in order to maintain law enforcement certification by the POST commission.
