Amends TCA Title 11; Title 47 and Title 55.

Present law authorizes, but does not require, registration of Class I and Class II off-highway vehicles (OHV). A Class I or Class II OHV that is registered and equipped with certain safety features, such as turn signal lights and seat belts, may be operated on county roads. Present law defines a Class I OHV to mean a motorized vehicle with not less than four nonhighway tires, nor more than six nonhighway tires, with a top speed greater than 35 mph, that is limited in total dry weight up to 2,500 lbs., that is 80" or less in width, and that has a nonstraddle seating capable of holding no more than four passengers and a steering wheel. This bill increases the maximum dry weight for a Class I OHV from 2,500 lbs. to 3,500 lbs. This bill also specifies that the 80" width limit for a Class I OHV must be based on a measurement taken from the outside of the tire rim to the outside of the tire rim.<br /> <br /> This bill makes similar changes to maximum dry weight and width measurement in descriptions of Class I OHV in the Tennessee Adventure Tourism and Rural Development Act of 2011 and the Motorcycle and Off-Road Vehicle Dealer Fairness Act.<br /> <br /> NOTE: Section 2 of this bill changes Tennessee Code Annotated, Section 11-11-203(3)(B), but the description most closely matching the provision that Section 2 changes appears in Section 11-11-203(3)(A).<br /> <br /> ON MARCH 22, 2021, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1046, AS AMENDED.<br /> <br /> AMENDMENT #1 makes technical corrections to reflect that this bill changes Tennessee Code Annotated, Section 11-11-203(3)(A), as referenced in the NOTE in this Bill Summary.<br />
