Amends TCA Section 36-5-101(g) and Section 36-5-103(f).

Under present law, a significant variance under the child support guidelines may serve as the basis for a court to modify the amount of an existing child support order.<br /> <br /> Present law requires that the significant variance established by the department of human services pursuant to the child support guidelines provide a lower threshold for modification of child support orders for persons whose adjusted gross incomes are within low income categories established by the guidelines. The significant variance involving low income persons must be established by rule at no more than 7.5 percent of the difference between the current child support order and the amount of the proposed child support order. This bill deletes the requirements concerning the establishment of a lower threshold for modification of child support orders for persons whose adjusted gross incomes are within low income categories.<br /> <br /> Generally, under present law, a party to a child support obligation may seek an increase or decrease of support based on a significant variance. This bill authorizes the department of human services, upon becoming aware of a change in circumstances of either party to a Title IV-D child support case, to review and seek an adjustment to the support obligation to the extent required by the child support guidelines.<br />
