Amends TCA Title 49, Chapter 6, Part 22.

Present law specifies that nothing in the provisions of law concerning textbooks and instructional materials prohibits the use of or applies to supplemental instructional materials. This bill adds a condition to present law by prohibiting public school teachers and principals from using or permitting to be used in the person's school, whether as a supplement to the LEA's or school's adopted textbooks and instructional materials or otherwise, textbooks or instructional materials created to align with the common core state standards.<br /> <br /> This bill prohibits the state textbook and instructional materials quality commission from publishing a list of, or recommending that the state board of education approve for use in the public schools of this state, textbooks or instructional materials created to align with the common core state standards. This bill also prohibits the state board of education from approving textbooks or instructional materials created to align with the common core state standards for use in the public schools of this state.<br /> <br /> ON MARCH 11, 2021, THE SENATE ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 769, AS AMENDED,<br /> <br /> AMENDMENT #1 limits this bill's prohibition on the recommendation, approval, or use of certain textbooks or instructional materials to those textbooks and materials created to align exclusively with the common core state standards and that are marketed or otherwise identified as common core textbooks or materials. This amendment clarifies that this bill applies to textbooks and materials for use in public schools.<br /> <br /> This amendment makes this bill's prohibitions against the use or permitting the use of common core textbooks and materials by a teacher or principal effective July 1, 2021, instead of upon becoming a law. This amendment also requires the commissioner of education to withhold a portion of an LEA's state education finance funds if a teacher or principal employed by the LEA intentionally violates this bill by purposefully using, or permitting to be used, in the person's school, textbooks or instructional materials created to align exclusively with the common core state standards and that are marketed or otherwise identified as common core textbooks or materials.<br /> <br /> ON MARCH 15, 2021, THE HOUSE SUBSTITUTED SENATE BILL 769 FOR HOUSE BILL 782, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 769, AS AMENDED.<br /> <br /> AMENDMENT #1 specifies that funds will be withheld, as discussed above in Senate Amendment #1, for the use of textbooks or instructional materials that are created to align exclusively with the common core state standards or (instead of "and") that are marketed or otherwise identified as common core textbooks or materials.<br />
