Amends TCA Section 41-22-116.

Generally under present law, goods that are manufactured, in whole or part, by inmates may not be sold or offered for sale in this state by any person, firm, association or corporation or by any federal authority, state, or political subdivision, except for inmates on parole or probation or in certain instances as provided by present law. There are certain exceptions to that provision and present law also provides that the prohibition does not apply to the sale, exchange, or disposition of those goods to any institution supported by funds derived from public taxation and operated under the supervision of the United States, this state, or any other state of the union or political subdivision thereof. Present law also provides that such goods may be offered for sale to private nonprofit corporations and charitable organizations that are duly chartered as such under the laws of this state and to private contractors if the goods are purchased will be subsequently used by a public agency or nonprofit organization. This bill : (1) Removes the above-described provision for sales to private contractors; (2) Specifies, in regard to sales to private nonprofit corporations and charitable organizations, that such sales must be on terms and conditions as the Tennessee rehabilitative in correction (TRICOR) board deems to be in the best interest of this state and the board must board determine that the sales do not unfairly compete with private sector businesses of this state; and (3) Requires that the inmates making such goods, wares, and merchandise be paid an appropriate wage so that the products do not unfairly compete with private sector businesses in this state. ON MARCH 25, 2021, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1069, AS AMENDED. AMENDMENT #1 authorizes sales to government entities in addition to private nonprofit corporations and charitable organizations.
