Amends TCA Title 57.
ON MARCH 22, 2021, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1085, AS AMENDED. AMENDMENT #1 rewrites this bill and adds to the definition of "premises" for purposes of the sale of alcoholic beverages for on-premises consumption that "premises", when referring to one or more establishments licensed for such sales in Clarksville within or adjacent to a certain specified area in downtown near the riverwalk (described in detail in the bill), include that certain specified area (and not just the licensed establishments in that area). This bill specifies that the granting of a license for a business located within or adjacent to the boundaries of the specified area does not preclude the granting of another license to another establishment located within or adjacent to such area. Generally under present law, licensees under the "premises" definition may not sell or give away alcoholic beverages and/or malt beverages and/or wine between the hours of 5:00 a.m. and 8:00 a.m. on weekdays or between the hours of 5:00 a.m. and 12:00 noon on Sundays. This bill specifies that Clarksville may, by ordinance, reduce or prescribed the hours and days upon which alcoholic beverages, beer, and wine may be consumed in the specified area, described above; however, the ordinance may not expand such hours and days beyond the limitations of present law.
