In an eminent domain proceeding, present law generally requires the jury to give the value of the land or rights taken without deduction. This bill adds as requirements in such proceedings that: (1) The jury must value the land or the rights taken at 130 percent of the fair market value; and (2) The jury must include as damages the value of the depreciation of the property caused by the taking of an easement.
