Amends TCA Section 55-9-302 and Section 55-9-308.

Present law generally requires persons to wear a helmet when riding a motorcycle, motorized bicycle, or motor-driven cycle. A person is exempt from the helmet requirement, if the person is riding: (1) Within an enclosed cab; (2) A fully-enclosed autocycle. An autocycle is a three-wheeled motorcycle that is equipped with safety belts, steering wheel, and non-straddle seating, and is manufactured to comply with federal safety requirements for motorcycles; (3) A golf cart; (4) In a parade, at a speed not to exceed 30 miles per hour, if the person is 18 years of age or older; or (5) In a funeral procession, memorial ride under a police escort, or body escort detail, subject to certain additional requirements. This bill adds a sixth exemption to the helmet requirement for persons riding three-wheeled motorcycles, including autocycles, if the rider is 25 years of age or older. Present law includes autocycles in the definition of "motorcycle" for purposes of the laws pertaining to required equipment on motorcycles. Present law includes a contradictory provision that purports to exempt autocycles from such laws. This bill clarifies present law by deleting the provision that states that autocycles are exempt from the laws pertaining to required equipment on motorcycles.
