Amends TCA Title 4; Title 7; Title 13 and Title 65.
This bill makes various changes to the Competitive Wireless Broadband Investment, Deployment, and Safety Act of 2018, as follows:<br /> <br /> (1) This bill specifies that the Act does not prohibit a local authority from preventing the installation of wireless facilities within 1,500 feet of a school or private residence or prohibit a local authority from preventing the installation of wireless facilities in a right-of-way that is within an area with existing internet coverage;<br /> <br /> (2) Present law provides that a local authority may require an applicant to seek permission by application to colocate a small wireless facility or install a new or modified potential support structure for a small wireless facility and obtain one or more work permits, as long as the work permits are of general applicability and do not apply exclusively to wireless facilities. Generally a local authority must approve or deny all small wireless facilities within an application within 60 days of receipt of the application. This bill increases the time period for acting on an application from 60 to 90 days and makes corresponding changes in other related provisions of the Act (including extending some extensions from 75 to 120 days);<br /> <br /> (3) Present law prohibits an authority from applying nondiscriminatory standards in a manner that precludes all deployment of small wireless facilities or precludes deployment of small wireless facilities as a permitted use pursuant to zoning requirements. This bill clarifies that this provision is subject to the existing present law provisions, as amended by this bill, regarding the application of the Act in regard to existing laws; and <br /> <br /> (4) This bill requires an applicant to annually:<br /> <br /> (A) Inspect its wireless facilities to ensure compliance with safety standards promulgated by the federal communications commission; and<br /> <br /> (B) Report to the local authority that approved the applicant's application concerning the results of the inspection.<br />
