Amends TCA Title 29, Chapter 16, Part 1.
This bill prohibits, for the purposes listed below, the use of eminent domain to acquire privately owned real property for trails, paths, or greenways for walking, running, hiking, bicycling, or equestrian use unless the privately owned real property is parallel to, runs directly along the length of, and extends in the same direction as a highway, road, or street. This bill's prohibition on the use of eminent domain applies to county public works and schools; municipal parks, public works projects, recreational systems, schools, sewers, streets, utilities, and water systems; and solid waste authorities. This bill specifies that its prohibition on the use of eminent domain does not apply when there is a written agreement between the owner of the real property and a planned unit development, homeowner's association, or business entity.
