Amends Chapter 1 of the Public Acts of 2021 (1st Ex. Sess.); Chapter 3 of the Public Acts of 2021 (1st Ex. Sess.) and TCA Title 49, Chapter 1, Part 9; and Title 49, Chapter 6, Part 31.

Effective July 1, 2022, the state board of education is required to promulgate rules (applicable to school years beginning with the 2022-2023 school year) to establish an appeal process, to be administered by the department of education, for a student who is identified for retention in third grade based on the student's achieving a performance level rating of "approaching" on the ELA portion of the student's most recent TCAP test. This bill adds that the rules must provide that if an appeal is filed, the filing must be made by the student's parent or guardian.<br /> <br /> Present law requires that, immediately upon determining that a student in kindergarten through grade three has a significant reading deficiency, based on the results of the universal reading screener most recently administered to the student, the LEA or public charter school must notify the student's parent in writing that the student has been identified to have a significant reading deficiency, and provide the student's parent with:<br /> <br /> (1) Information about the importance of a student being able to read proficiently at the end of the third-grade level; <br /> <br /> (2) Reading intervention activities that the parent may use with the parent's student at home to improve reading proficiency; and <br /> <br /> (3) Information about the specific reading interventions and supports that the LEA or public charter school recommends for the student.<br /> <br /> Effective July 1, 2022, this bill adds that, in addition to the information required in (1)-(3), the notice must also include Information about mandatory retention for students in grade three with an achievement level of "approaching" or "below" on the ELA portion of the student's most recent TCAP test.<br />
