Amends TCA Title 4 and Title 49.

This bill declares that it is state policy that state revenues and resources should not be expended on, or provided to, persons present in the U.S. unlawfully. Under this bill, if an LEA or public charter school chooses to enroll a student who is unlawfully present in the U.S., then the department of education will be required to withhold from the LEA or public charter school, for each such student, the amount representing the per pupil state funds generated through the BEP for the LEA in which the student resides. This bill prohibits the department from counting a student who is unlawfully present in the U.S. as part of the BEP calculations for an LEA. This bill requires that an LEA or public charter school that enrolls a student who is unlawfully present in the U.S. be solely responsible for all costs associated with educating the student. This bill requires each LEA and public charter school to report: (1) Whether the LEA or public charter school will allow students who are unlawfully present in the U.S. to enroll in public school in the upcoming school year; and (2) Beginning with the 2022-2023 school year, the number of students enrolled in the LEA or public charter school who are unlawfully present in the U.S.
