ON MARCH 28, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1664, AS AMENDED. AMENDMENT #1 rewrites this bill to specify that posting a review on the internet about a business that is factually false is a violation of the Consumer Protection Act of 1977. Under present law, a violation of the Consumer Protection Act of 1977 is generally a Class B misdemeanor offense and gives rise to a cause of action against the violator for which a court may award treble damages and attorney's fees. If a person violates the Act by posting a review on the internet about a business that is factually false, this amendment requires (rather than authorizes) the court in a civil action arising from the violation to award treble damages and attorney's fees.
