This bill requires each county election commission, in collaboration with the secretary of state, to investigate the results of the 2020 general election for president and U.S. congress in this state and creates an ad hoc election integrity subcommittee of the joint government operations committees of the house and senate. In conducting the investigation of the 2020 general election, this bill requires each county election commission to perform: (1) A forensic audit of each ballot available for review from the 2020 general election; (2) A complete canvassing of each ballot for purposes of confirming the vote tallies for each race; and (3) A thorough review of the chain of custody for ballots, ballot boxes, and voting machines and equipment. This bill requires each election official to cooperate with the respective county election commission and meet each deadline established by the commission for purposes of meeting the requirements of this bill. If an election official does not timely cooperate with the respective county election commission's investigation, upon referral of the matter by the county election commission, the appropriate district attorney general will be required to seek a writ of mandamus ordering the election official to comply with the request of the county election commission. This bill requires each county election commission to report its findings to the secretary of state no later than June 1, 2022. The secretary of state will then aggregate the county reports and compile a final report and submit the report to the ad hoc election integrity subcommittee no later than June 10, 2022. The ad hoc election integrity subcommittee created by this bill will be composed of six members from among the members of the joint government operations committee, with three of the six selected by the senate speaker and three selected by the house speaker. Each speaker will designate from among the speaker's selected members a co-chair to serve on the subcommittee. This bill requires the joint government operations committee to call a meeting of the ad hoc election integrity subcommittee as soon as practicable after submission of the final report of the secretary of state. After evaluating the final report of the secretary of state, the subcommittee must submit its findings to the full body of the joint government operations committee no later than June 17, 2022. The joint government operations committee must convene to review the final report of the secretary of state and the findings of the subcommittee no later than June 24, 2022. This bill requires the committee to report its findings to the governor, the speaker of the senate, and the speaker of the house no later than July 1, 2022.
