Amends TCA Title 49.

Present law requires the board of education of a school district to adopt and file its policy on inspection of school instructional materials by parents or legal guardians of students enrolled in that local education agency (LEA) in its official operating policy pamphlet. The policy must allow a parent or legal guardian to: (1) Review all teaching materials, instructional materials, and other teaching aids used in the classroom of the parent or legal guardian's child; and (2) Review tests that are developed by and graded by a teacher of the parent or legal guardian's child. Also, under present law, the LEA must make all teaching materials readily available for review upon request by the parents or legal guardians. This bill additionally requires that the policy: (1) Allow a student's parent or legal guardian to check out from the school one set of the instructional materials used in the classroom of the parent's or legal guardian's student for a period of no less than 48 hours to allow the parent or legal guardian to inspect the materials; and (2) Require a parent or legal guardian who checks out instructional materials from a school to execute a document in which: (A) The parent or legal guardian is advised of: copyright protections applicable to the instructional materials; the fees and costs that may be charged by the school to the parent or legal guardian for instructional materials check out that are not timely returned to the school, or that are returned to the school in an incomplete, unusable, or damaged condition; and the LEA's ability to withhold the grade cards, diplomas, certificates of progress, or transcripts of the parent's or legal guardian's student if any fees or costs charged by the school as referenced in this bill are not paid; and (B) The parent or legal guardian: attests to receiving the information required in item (2)(A); and agrees to comply with all copyright protections applicable to the instructional materials and to timely return the materials to the school in the same quantity and condition the materials were in at the time the materials were checked out. This bill allows an LEA to authorize the LEA's schools to charge a parent or legal guardian who checks out instructional materials from the school: (1) A reasonable fee for the parent's or legal guardian's failure to timely return the instructional materials to the school; and (2) The costs necessary to repair or replace instructional materials that are not returned to the school, or that are returned to the school in an incomplete, unusable, or damaged condition.
