Amends TCA Title 49.

This bill requires local boards of education to adopt a bereavement policy for employees of a local education agency (LEA). The policy must: (1) Authorize three days of bereavement leave for the death of a member of the employee's immediate family; (2) Authorize one day of bereavement leave for the death of a member of the employee's family who is not immediate family; (3) In addition to the leave in (1) and (2), authorize: (A) One day of bereavement leave for the death of an immediate family member if the immediate family member's funeral service is located more than 150 miles from where the employee resides; and (B) Two days of bereavement leave for the death of an immediate family member if the immediate family member's funeral service is located more than 750 miles from where the employee resides; and (4) Authorize leave in the event of the death of an employee or student of the LEA. The policy must provide that the principal of the school the deceased student attended or the immediate supervisor of the deceased employee may grant bereavement leave to an appropriate number of employees for a sufficient amount of time for the employees to attend the funeral service, as specified in the local board of education's policy. In regard to the leave described above in (3), this bill provides that the employee must provide proof of the death and proof of the funeral location, and the employee who receives leave under (3)(B) may not receive leave under (3)(A). This bill specifies that employees on bereavement leave must receive full pay for each day of leave authorized by this bill. Bereavement leave used by an employee must not be deducted from the employee's accumulated sick, annual, or other leave balances.
