Amends TCA Title 53, Chapter 10; Title 53, Chapter 11 and Title 63.

Under present law, it is unlawful for any person knowingly or intentionally to, among other things, acquire or obtain, or attempt to acquire or attempt to obtain, possession of a controlled substance by misrepresentation, fraud, forgery, deception or subterfuge. This bill adds that an employer of a healthcare prescriber that has reasonable suspicion that the healthcare prescriber has violated the above prohibition while so employed must report such violation to the Tennessee bureau of investigation and to the sheriff of the county or to the chief law enforcement officer of the municipality where the violation occurred. The report must include the name of the healthcare prescriber, the time and location of the alleged violation, and pertinent facts regarding the violation. The employer must also file a report with the department of health's office of investigations and the division of health related boards in the department of health. Upon the commencement of a criminal investigation pursuant to this bill, the office of investigations and the division of health related boards must provide to the investigating officer or agent a complete and unredacted copy of the applicable investigative file.
