Amends TCA Title 40.

This bill adds to the provisions governing prohibited activities by registered sexual offenders.<br /> <br /> Under present law, while mandated to comply with the requirements of the sex offender registry, it is Class A misdemeanor for a sexual offender, violent sexual offender or a violent juvenile sexual offender whose victim was a minor, to knowingly:<br /> <br /> (1) Pretend to be, dress as, impersonate or otherwise assume the identity of a real or fictional person or character or a member of a profession, vocation or occupation while in the presence of a minor or with the intent to attract or entice a minor to be in the presence of the offender;<br /> <br /> (2) Engage in employment, a profession, occupation or vocation, regardless of whether compensation is received, that the offender knows or should know will cause the offender to be in direct and unsupervised contact with a minor; or<br /> <br /> (3) Operate, whether authorized to do so or not, any vehicle or specific type of vehicle, including, but not limited to, an ice cream truck or emergency vehicle, for the purpose of attracting or enticing a minor to be in the presence of the offender. <br /> <br /> This bill adds that while mandated to comply with the requirements of registry, it is a Class A misdemeanor for a sexual offender, violent sexual offender, or a violent juvenile sexual offender to knowingly rent or offer to rent a swimming pool, hot tub, or other body of water to be used for swimming that is owned by the offender.<br /> <br /> ON MARCH 7, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1922, AS AMENDED.<br /> <br /> AMENDMENT #1 specifies that this bill applies to pools, hot tubs, and other bodies of water used for swimming "located on property owned or leased by the offender or is otherwise under the control of the offender."<br /> <br /> ON APRIL 11, 2022, THE SENATE SUBSTITUTED HOUSE BILL 1922 FOR SENATE BILL 1786, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 1922, AS AMENDED.<br /> <br /> AMENDMENT #1 specifies that this bill's provisions regarding swimming pools and other bodies of water apply to offenders who are mandated to comply with the registry requirements for a sexual offense or violent sexual offense that occurred on or after July 1, 2022.<br /> <br /> ON APRIL 21, 2022, THE HOUSE NON-CONCURRED IN SENATE AMENDMENT #1.<br /> <br /> ON APRIL 27, 2022, THE SENATE REFUSED TO RECEDE IN ITS ACTION IN ADOPTING SENATE AMENDMENT #1.<br /> <br /> ON APRIL 27, 2022, THE HOUSE REFUSED TO RECEDE FROM ITS NONCONCURRENCE IN SENATE AMENDMENT #1 AND APPOINTED A CONFERENCE COMMITTEE.<br /> <br /> ON APRIL 27, 2022, THE SENATE APPOINTED A CONFERENCE COMMITTEE.<br /> <br /> ON APRIL 28, 2022, THE HOUSE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE HOUSE.<br /> <br /> ON APRIL 28, 2022, THE SENATE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE SENATE.<br />
