Amends TCA Title 2.

Present law establishes requirements for governmental entities that have a charter provision for a petition for recall, referendum or initiative. Under present law, those provisions do not apply in Davidson County; this bill removes that Davidson County exemption. The present law provisions specify that they control notwithstanding any statutory provision or charter provision of a municipality or county to the contrary; however, a contrary charter provision of a municipality or county which is enacted after July 1, 1997, controls with respect only to the requirements relating to the statutory minimum number of signatures required in a petition, and to the provisions relating to a 75-day deadline for filing of a petition after final certification by the county election commission. This bill removes the provision whereby a charter provision control over general law with respect to the statutory minimum number of signatures required in a petition. ON FEBRUARY 28, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2277, AS AMENDED. AMENDMENT #1 deletes the section of this bill that would have removed the provision whereby a charter provision controls over general law with respect to the statutory minimum number of signatures required in a petition.
