Amends TCA Title 4; Title 5; Title 6; Title 7; Title 12 and Title 47.

This bill requires that certain products used in the fulfillment of a contract with a public agency be manufactured in the United States.<br /> <br /> This bill requires a public agency to include a provision in a contract for the construction, alteration, or repair of public buildings and public works that the iron, steel, and manufactured goods used or supplied in the performance of the contract be manufactured in the United States. This bill authorizes the head of a public agency to grant a waiver from the above requirement, if the head determines that:<br /> <br /> (1) Application of the requirement is inconsistent with the public interest;<br /> <br /> (2) The necessary material and product is not produced in the United States in sufficient and reasonably available quantity of a satisfactory quality; or<br /> <br /> (3) Inclusion of domestic material will increase the cost of the overall project contracted by more than 25 percent.<br /> <br /> If the head of a public agency receives a waiver request, then the public agency must provide notice and an opportunity for public comment on the request at least 30 days before issuing a decision approving or disapproving the waiver request. <br /> <br /> This bill makes a person ineligible to receive a contract with a public agency if a court, federal agency, or public agency has determined that the person intentionally:<br /> <br /> (1) Affixed a label bearing a "Made in America" inscription, or an inscription with the same meaning, to iron, steel, or a manufactured good used in the fulfillment of a contract and in compliance with this bill, but not manufactured in the United States; or<br /> <br /> (2) Represented that iron, steel, or a manufactured good used in the fulfillment of a contract and in compliance with this bill was manufactured in the United States if it was not.<br />
