Amends TCA Title 10, Chapter 7 and Section 38-10-102.

Present law requires state and local law enforcement agencies, correctional agencies, and courts to submit to the director of the Tennessee bureau of investigation reports setting forth their activities in connection with law enforcement and criminal justice, including uniform crime reports and reports of law enforcement-related deaths.<br /> <br /> This bill requires all government entities required to make the reports described above to maintain a record of deaths of individuals in custody pursuant to an arrest or a transfer between institutions. The record must be open for public inspection and contain:<br /> <br /> (1) The identity and age of the deceased individual;<br /> <br /> (2) The time and date of the death;<br /> <br /> (3) The cause of death as determined by the county medical examiner when the cause of death has been determined by the county medical examiner; and<br /> <br /> (4) Facts concerning the death of the individual that are in the possession of a government entity; however information that is relevant to an ongoing investigation may be redacted.<br /> <br /> ON MARCH 24, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2613, AS AMENDED.<br /> <br /> AMENDMENT #1 removes facts concerning the death (as described above in the bill summary in (4)) from the information required to be included in the record and rewrites the cause of death information requirement (described above in (3)) to require inclusion of the cause of death as determined by the county or state medical examiner.<br />
