Amends TCA Title 3, Chapter 7 and Title 9, Chapter 4.
ON APRIL 4, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2674, AS AMENDED. AMENDMENT #1 rewrites this bill and revises the present law requirement that for any law enacted after January 1, 2022, that results in a net increase in periods of imprisonment in state facilities, there must be appropriated from recurring revenues the estimated operating costs of the law. This amendment changes the applicable date in the requirement to January 1, 2023. This amendment makes the same date change in the present law that for any law enacted after January 1, 2022, that results in a net decrease in periods of imprisonment in state facilities, the appropriations described above must be decreased by the estimated amounts annually that account for the estimated decrease in operating costs of the law. Under present law, the required annual decrease in appropriations must be made in the general appropriations act as a line item reduction for the next 10 years commencing after the effective date of the law; this amendment changes that time period from 10 years to three years. Under present law, the amount of appropriations must be equal to the amounts reflected in fiscal notes prepared by the staff of the fiscal review committee. Present law provides that cost increases must be estimated based on the operating costs, in current dollars, of the highest of the next 10 fiscal years commencing after July 1, 2021. This amendment changes the time period to three years and the applicable date to July 1, 2022, and adds that should the fiscal note include both increases and decreases, the costs must be netted out on an annual basis for the next three fiscal years commencing after July 1, 2022. This amendment provides that netted out cost increases must be based on the operating costs of the highest of the next three fiscal years on a recurring basis, and that netted out cost decreases must be based on actual estimated decreases for each of the next three fiscal years. This amendment will apply to appropriations made on or after January 1, 2023.
