Present law establishes registries for animal abusers and sex offenders. The registry for animal offenders consists solely of a publicly accessible database where the identities of convicted animal abusers are published for a limited amount of time. The registries for sex offenders include publicly accessible databases, but also require monitoring and place various limits on offenders' proximity to their victims in particular and juveniles in general.<br /> <br /> This bill creates within the TBI a registry of persons convicted of a criminal offense involving assault, homicide, kidnapping and false imprisonment, or a sexual offense in which the victim is a domestic abuse victim. The registry will be similar to the animal abuser registry in that it will only consist of a publicly accessible database. This bill requires court clerks to forward to the TBI a copy of the judgment and the date of birth of all persons who are convicted of a criminal offense to which this bill applies within 45 days of the judgment.<br /> <br /> The registry created by this bill will include an offender's name, date of birth, offense or offenses requiring the person's inclusion on the registry, conviction date, and county or counties of conviction. The TBI will maintain the name and other identifying information of offenders who are subject to inclusion on the registry:<br /> <br /> (1) For a period of one year following the completion of the person's sentence for a first or second qualifying conviction, after which time the offender will be removed from the registry if the offender does not commit another qualifying offense during the one-year period;<br /> <br /> (2) For a period of two years following the completion of the person's sentence for a third qualifying conviction, after which time the offender will be removed from the registry if the offender does not commit another qualifying offense during the two-year period; and<br /> <br /> (3) For a period of five years following the completion of the person's sentence for a fourth or subsequent qualifying conviction, after which time the offender will be removed from the registry if the offender does not commit another qualifying offense during the five-year period.<br /> <br /> This bill also requires the TBI to remove a person's information from the registry if the person's conviction is expunged.<br />
