Amends TCA Title 4; Title 5; Title 6; Title 39; Title 57; Title 62; Title 68; Title 69 and Title 70.

This bill creates a 13-member CLEAN commission, to consist of the following members: (1) A gubernatorial appointee representing county governments; (2) A gubernatorial appointee representing the agriculture industry; (3) A gubernatorial appointee representing the solid waste industry; (4) A gubernatorial appointee representing the conservation community; (5) Two representatives of retailers who sell or give away beverage containers or carryout bags, one appointed by the speaker of each chamber of the general assembly; (6) Two representatives of manufacturers or distributors of beverage containers or carryout bags, one appointed by the speaker of each chamber of the general assembly; (7) Two representatives of businesses that utilize recycled glass, aluminum, or plastic in their manufacturing operations, one appointed by the speaker of each chamber of the general assembly; (8) The commissioner of environment and conservation or the commissioner's designee; (9) The commissioner of transportation or the commissioner's designee; and (10) The commissioner of agriculture or the commissioner's designee. The terms of initial appointees to the commission will be staggered. Thereafter, the speakers' appointees will serve four-year terms and the governor's appointees will serve six-year terms. The full text of this bill describes various organizational and procedural requirements for the commission. The commission will be subject to governmental entity review. The commission members will not be compensated for their services on the commission but receive reimbursement for expenses and expenses incurred in attending meetings. This bill requires the commission to do the following by June 30, 2026: (1) Create and implement a program for plastic, glass, and aluminum beverage containers that recovers 85 percent of beverage containers sold within this state, for the purpose of recycling. For purposes of this bill, a "beverage container" means an individual, separate, and sealed single use container that is made entirely or of any combination of glass, aluminum, steel, other metal, or plastic, regardless of size, and is used for containing, at the time of sale to a consumer, a beverage for consumption; (2) Reduce a key constituent of litter on the landscape, source of contamination to recycling systems, source of injury to wildlife and livestock, and threat to this state's agricultural industry by developing a carryout bag reduction program to address the proliferation of carryout bags, for the purpose of recycling. For purposes of this bill, a "carryout bag" means a bag that is designed for one use and provided gratuitously by a grocery store, retail store, or food service establishment at the point of sale for the purpose of transporting groceries, prepared foods, or consumer goods. The full text of this bill specifies several types of bags that are not a carryout bag; (3) Develop and implement a statewide litter program to comprehensively address litter prevention and reduction; and (4) Evaluate existing state laws, and any administrative rules pertaining to such laws, that address litter, report to the general assembly on the effectiveness of the laws and rules, and make recommendations on how the laws and rules may be improved upon. The full text of this bill specifies various powers that the commission will be required to exercise in order to develop and implement the programs described in (1)-(3). Beginning in 2027, this bill requires the commission to submit an annual report to the governor and the general assembly upon its implementation of the programs described in (1)-(3). The commission will be authorized to promulgate rules to effectuate the purposes of this bill. Prior to the commission developing and implementing the programs described in (1)-(3), performing the evaluation of current laws and rules, and making reports, this bill requires TACIR to research, evaluate, and develop recommendations in order to determine the most effective methods and actions necessary to effectuate the purposes of this bill.
