Amends TCA Title 55, Chapter 25.
ON APRIL 27, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2763, AS AMENDED.<br /> <br /> AMENDMENT #1 rewrites this bill. Generally under present law, the department of motor vehicles is prohibited from knowingly disclosing or otherwise making available to any person or entity personal information about any person obtained by the department in connection with a motor vehicle record. Present law contains exceptions to this prohibition, whereby certain disclosures may be made, including the following two exceptions, which this amendment will delete:<br /> <br /> (1) For any other use in response to requests for individual motor vehicle records if the state has obtained the express consent of the person to whom the personal information pertains. It should be noted that there is a separate present law provision whereby personal information may be disclosed to any requesting person, if the person demonstrates, in the form and manner the department prescribes, that such person has obtained the written consent of the person who is the subject of the information; and<br /> <br /> (2) In bulk distribution for surveys, marketing or solicitations if the state has obtained the express consent of the person to whom the personal information pertains.<br />
