Amends TCA Title 39.
ON MARCH 14, 2022, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 2535, AS AMENDED. AMENDMENT #1 rewrites this bill to classify as the Class A misdemeanor offense "unlawful exposure" the distribution of an image of an identifiable person engaged in sexually explicit conduct if: (1) The image was photographed or recorded under circumstances where the parties agreed or understood that the image would remain private; and (2) The person depicted in the image suffers emotional distress. For purposes of this amendment and conduct that constitutes unlawful exposure under present law, this amendment defines "identifiable person" to mean a person who is identifiable from the image itself or from information transmitted in connection with the image.
