Amends TCA Title 49, Chapter 1; Title 49, Chapter 2; Title 49, Chapter 5 and Title 49, Chapter 6.
This bill expands the applicability of the requirement to implement family life education and prohibits certain abortion-related communications at an LEA or school-sponsored activity, as discussed below.<br /> <br /> Under present law, every LEA within a county must locally devise, adopt, and implement a program of family life education if the most recent, annual data maintained by the department of health, center for health statistics, indicate that pregnancy rates in the county exceeded 19.5 pregnancies per 1,000 females 15 through 17 years of age. This bill rewrites this requirement for the implementation of family life education applicable to all LEAs, beginning with the 2021-2022 school year.<br /> <br /> Present law requires each LEA that offers sex education to locally develop and adopt a family life curriculum in compliance with statutory requirements, or adopt the family life curriculum adopted by the state board of education. This bill instead requires each LEA to:<br /> <br /> (1) Locally develop, adopt, and implement a family life curriculum in compliance with the statutory requirements and the standards adopted by the state board of education; or<br /> <br /> (2) Adopt and implement a family life curriculum approved by the department of education that complies with the statutory requirements and the standards adopted by the state board of education.<br /> <br /> Present law requires the state board of education to adopt a complete family life curriculum suitable for implementation by an LEA that fails to develop, adopt, and implement a local curriculum of family life. This bill instead requires the department of education to post on the department's website a list of family life curricula that meet the standards adopted by the state board of education, and that are suitable for implementation by an LEA that does not locally develop, adopt, and implement a family life curriculum.<br /> <br /> Also, this bill prohibits a person from making abortion referrals or otherwise advocating or encouraging abortion while the person is present on school property or while the person is present at, or engaged in, any LEA-or school-sponsored activity, program, or event required as part of the person's employment or contract with an LEA or public school, or required as part of the person's provision of services to an LEA or public school.<br /> <br /> For purposes of the above prohibition, this bill defines "person" as an individual, partnership, committee, association, corporation, or any other organization or group of persons:<br /> <br /> (1) Employed by, or under contract with, an LEA or public school, including public charter schools, or<br /> <br /> (2) Providing services, including volunteer services, to an LEA or public school, including public charter schools.<br />
