Amends TCA Section 2-7-143.
Present law restricts the extent to which governmental entities, home owner's associations ("HOA"), and lessors of residential property may regulate or prohibit political signage.<br /> <br /> During a time period beginning 60 days before a general election until the day after the next subsequent election the state, a local government, or any other political subdivision of this state is generally prohibited from regulating the shape or quantity of political or campaign posters or signs placed on private property that is located more than 100 feet from a polling place if the signs or posters are placed on the property by the owner of the property or any lawful resident of a residence on the property. A political subdivision may, however, prohibit any political or campaign poster or sign covered by the general prohibition that exceeds:<br /> <br /> (1) 32 square feet in size and is located on commercial property; or<br /> <br /> (2) 16 square feet in size and is located on residential property.<br /> <br /> Present law also authorizes political subdivisions to adopt reasonable restrictions limiting the number of political campaign signs or posters that may be placed on property; provided, that such restrictions authorize an owner or resident to place at least one poster or sign on the property per candidate, issue, or subject.<br /> <br /> During a time period beginning 60 days before a general election until the day after the next subsequent election, an HOA is generally prohibited from prohibiting the display of political or campaign posters or signs placed on private property by the owner of the property or any lawful resident of a residence on the property. An HOA may adopt reasonable restrictions concerning sign placement and limiting the size of political signs to four square feet. The provisions of present law concerning HOAs apply to any clause, covenant, condition, restriction, or rule contained in any agreement or contract between a HOA and property owner that is executed or modified after July 1, 2017.<br /> <br /> This bill makes the present law restrictions on regulation of political signage applicable during the period beginning 60 days before a primary or general election until the day after the next subsequent general election.<br />
