Amends TCA Title 4; Title 5; Title 6; Title 7; Title 8 and Title 50.
Present law requires private employers to remit wages to their employees at least once a month. Present law establishes deadlines by which an employee must be paid for their compensation earned in the preceding pay period. For example, an employer who pays employees monthly must pay employees all wages earned and unpaid prior to the first day of any month by the fifth day of the succeeding month. The final wages of an employee who quits or is discharged includes any vacation pay or other compensatory time that is owed to the employee by virtue of company policy or labor agreement. This bill instead specifies that the final wages of an employee who quits or is discharged includes accrued, but unused, vacation pay or other compensatory time. This bill voids any provision in a company policy or labor agreement providing to the contrary.
