ON MARCH 22, 2021, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 866, AS AMENDED. AMENDMENT #1 rewrites this bill and authorizes a delivery service licensee to charge a fee based on a percentage of the sales of the alcoholic beverages or beer being delivered. The delivery service licensee may not charge a fee that exceeds 10 percent of the price of each alcoholic beverage or beer sold. This bill specifies that the delivery service licensee will not be responsible for remitting applicable taxes on alcoholic beverages or beer delivered by the licensee. This bill further specifies that the charging of such a fee must not be construed as the delivery service reselling alcoholic beverages or having a direct or indirect interest in a retailer.
