ON APRIL 27, 2021, THE SENATE SUBSTITUTED HOUSE BILL 1145 FOR SENATE BILL 285, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 1145, AS AMENDED. AMENDMENT #1 rewrites the bill and revises the present law offense of critical infrastructure vandalism. Under present law, a person who knowingly destroys, injures, interrupts, or interferes with critical infrastructure or its operation commits the offense of critical infrastructure vandalism. Under this amendment, such offense occurs when a person knowingly: (A) Interrupts or interferes with critical infrastructure or its operation; or (B) Destroys or injures critical infrastructure or a farm. For the purposes of this amendment, "farm" means the land, buildings, and machinery used in the commercial production of farm products and nursery stock and includes the real property, vehicles, equipment, machinery, animals, or crops contained on a farm. Under present law and this bill, the offense is punished as theft, with the penalty being dependent on the value of the property, but in no case is the punishment less than a Class E felony.
