Amends TCA Title 8 and Title 50.

This bill:<br /> <br /> (1) Authorizes each commissioner of a department of state government, in consulting with its appointing authorities and employees, to develop standards for identifying hazardous duty positions within the department and categorize working conditions not common to a class of employees as mildly hazardous, moderately hazardous, and severely hazardous. If a commissioner develops such standards and categories, then the commissioner must consult with and solicit input from the commissioners of finance and administration and human resources;<br /> <br /> (2) Upon determining a state employee or class of employees is eligible for a hazardous salary adjustment under this bill, authorizes the appointing authority to apply to the appropriate commissioner for the salary adjustment and requires the appointing authority, for each such application, to provide sufficient evidence and documentation to substantiate the claim for hazardous salary adjustment. Upon review of an application, the commissioner may approve a hazardous salary adjustment for a qualified employee or class of employees. Each adjustment must be submitted as a separate application. The commissioners of finance and administration and human resources may audit any claim to determine if a salary adjustment was appropriate; and<br /> <br /> (3) Authorizes, when the working conditions of a state employee are exceptionally hazardous and fall within one of the categories for hazardous working conditions developed in item (1) above, paying the state employee, upon approval in accordance with this bill, a hazardous salary adjustment granted only for the time the employee is subjected to the hazardous working condition;<br /> <br /> (4) Provides, for the purposes of approving a salary adjustment, that a state employee will be entitled to an adjustment as follows: 5 percent of the employee's base salary for those hours worked under mildly hazardous conditions; 7.5 percent of the employee's base salary for those hours worked under moderately hazardous conditions; and 10 percent of the employee's base salary for those hours worked under severely hazardous conditions; and <br /> <br /> (5) Requires a state agency to compensate a former state employee for an approved hazardous salary adjustment for work performed regardless of whether approval occurs after the state employee transfers to another state agency or is separated from service. <br />
