Amends TCA Title 3, Chapter 17, Part 1; Section 8-21-205 and Title 48, Chapter 101, Part 5.

This bill revises various provisions regarding funds collected by the department of state, as follows: (1) Tennessee Nonprofit Gaming Law. This bill: (A) Reduces the following fees under the Law to be $10.00 for the period of July 1, 2021, through January 31, 2022: the $50.00 initial application fee for an annual event; the fee for annual event applications, which is set by rules of the secretary of state and can be up to $700; the $25.00 fee for late filing of a financial accounting; and (B) Under present law, funds collected under the Law must be used by the secretary and the TBI to defray the cost of administering the Law. This bill revises this provision to instead require that the funds be used by the secretary of state to defray the cost of operating the division of the department of state administering the Law; (2) Fees for business services. Under present law, a percentage of the fees collected by the secretary of state related to services performed under certain business organization acts (such as the Tennessee Business Corporation Act) and of the fees collected by the secretary for service of process under applicable statutes are retained by the secretary for continuing improvement of its filing, service and copying duties; this bill requires instead that such funds be used to defray the cost of operating the division of the department of state administering the referenced acts; (3) Solicitation of charitable funds. This bill reduces to $10.00 the following fees for the period of July 1, 2021, through January 31, 2022: the $50.00 initial registration fee; the registration renewal fee which ranges from $80.00 to $240 depending on the organization's gross revenue; the $25.00 late renewal fee; the $25.00 late application fee for professional solicitors; and the $25.00 fee for a late report from a professional solicitor. Also, under present law, funds collected under charitable solicitation law must be used by the secretary of state to defray the cost of administering the laws; this bill requires instead that the funds be used to defray the cost of operating the division of the department of state administering this laws.
