Amends TCA Title 57, Chapter 2 and Title 57, Chapter 3.

This bill requires persons applying for a manufacturer or distiller license to provide the alcoholic beverage commission with names and percentage of ownership of any person having more than 10 percent interest in the manufacturer or distiller, as discussed below. Under present law, a manufacturer's or distiller's license may be issued for the manufacturing of alcoholic spirituous beverages or vintage alcoholic beverages. A person, firm, or corporation desiring to manufacture for commercial purposes any alcoholic spirituous beverages or vintage alcoholic beverages must make application to the commission for a license to manufacture the same. This bill adds to present law that a person applying for or renewing a license must provide the following information to the commission with regard to individuals or entities with more than 10 percent direct or indirect interest in the manufacturer or distiller to be licensed: (A) The names of any such individual or entity; (B) The percentage of ownership; and (C) Any other information requested by the commission. In regard to individuals or entities with 10 percent or less direct or indirect interest in the manufacturer or distiller to be licensed, the information in items (A) and (B) above must be provided, but the commission must not request any other information regarding such individuals or entities. Also, a person who is applying for or renewing a license that has more than 20 owners will not be required to provide information required by items (A)-(C) above; however, an individual owner with a direct or indirect interest of more than 10 percent will be required to provide the commission with the information in items (A)-(C) above if requested to do so by the commission. This bill authorizes the commission to require additional information that is necessary for the commission to verify compliance with the laws governing manufacturers and distillers and all other applicable laws, except that with regard to any owner with a 10 percent or less direct or indirect interest in a manufacturer or distiller where the owner affirms or attests to the commission that such owner is eligible to have such an interest, then the commission must not request any additional information regarding such owner, unless the commission has reason to believe that such affirmation or attestation is false.
