Amends TCA Title 10, Chapter 7, Part 5.

ON MARCH 24, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1402, AS AMENDED. AMENDMENT #1 rewrites this bill and: (1) Prohibits named parties in litigation with or against a governmental entity from circumventing discovery under the Tennessee Rules of Civil Procedure or the subpoena process and powers of the courts by seeking records from a governmental entity under the laws governing public records; and (2) Adds, in regard to the present law provision whereby a governmental entity may require any person making a request to view or make a copy of a public record to present a government-issued photo identification, if the person possesses photo identification, that includes the person's address, that the governmental entity may require the person to certify in writing, at the time of the request, that the person is not making the request on behalf or at the request of another person or entity.
