Amends TCA Title 4; Title 29; Title 33; Title 38; Title 39; Title 40; Title 41, Chapter 1, Part 1; Title 43; Title 45; Title 53; Title 63; Title 67; Title 68 and Title 71, Chapter 3, Part 12.

This bill does the following with regard to present law concerning marijuana:<br /> <br /> (1) Removes authorization for the highway patrol and TBI to use dogs trained to detect marijuana;<br /> <br /> (2) Removes marijuana from the types of substances the possession of which triggers liability under the Drug Dealer Liability Act;<br /> <br /> (3) Removes from the definition of "drug paraphernalia", for purposes of criminal laws concerning drugs, objects used, intended for use, or designed for use in ingesting, inhaling, or otherwise introducing marijuana, marijuana concentrates, marijuana oil, hashish, or hashish oil into the human body;<br /> <br /> (4) Removes marijuana and tetrahydrocannabinols from the schedule of controlled substances; and<br /> <br /> (5) Deletes criminal penalties for manufacture, delivery, sale, and distribution of marijuana.<br /> <br /> This bill will take effect the first day of the first month that is at least 30 days following the effective date of legislation passed by the U.S. Congress that removes marijuana from the federal Controlled Substances Act of 1970.<br />
