Amends TCA Section 4-5-215.
ON APRIL 8, 2021, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 4072, AS AMENDED. AMENDMENT #1 rewrites the bill to replace the present law provision whereby the government operations committees of the house and senate may only stay the running of a rule for a period of time not to exceed 75 days. Under this amendment, such committees may stay the running of a rule for a period of time that does not extend past the fifth legislative day of the subsequent year from when the rule is filed with the office of secretary of state if either committee determines a stay is necessary to prevent irreparable harm to a person or property. ON APRIL 14, 2021, THE SENATE SUBSTITUTED HOUSE BILL 570 FOR SENATE BILL 1086, ADOPTED AMENDMENT #1, AND RESET HOUSE BILL 570, AS AMENDED. AMENDMENT #1 rewrites this bill. Under present law, a rule does not become effective until 90 days after the filing of such rule in the office of the secretary of state. Prior to the effective date of a rule, the house of representatives or senate government operations committee may stay the running of the 90-day period, for a period of time not to exceed 75 days. This amendment adds that if either committee determines that subsequent stays are necessary the committee may issue consecutive stays, each for an additional 75 day period, so long as such stays do not extend beyond the fifth legislative day of the year following the year in which the rule is filed with the office of the secretary of state. ON APRIL 15, 2021, THE SENATE FURTHER CONSIDERED HOUSE BILL 570, ADOPTED AMENDMENT #2, AND PASSED HOUSE BILL 570, AS AMENDED. AMENDMENT #2 requires that any second or subsequent stay of a rule will require the approval of the government operations committees of both chambers acting jointly. ON APRIL 21, 2021, THE HOUSE CONCURRED IN SENATE AMENDMENT #1 AND NONCONCURRED IN SENATE AMENDMENT #2. ON APRIL 26, 2021, THE SENATE REFUSED TO RECEDE IN ITS ACTIONS IN ADOPTING SENATE AMENDMENT #2. ON APRIL 28, 2021, THE HOUSE REFUSED TO RECEDE FROM ITS NONCONCURRENCE IN SENATE AMENDMENT #2 AND APPOINTED A CONFERENCE COMMITTEE. ON APRIL 29, 2021, THE SENATE APPOINTED A CONFERENCE COMMITTEE. ON MAY 4, 2021, THE HOUSE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE HOUSE. ON MAY 5, 2021, THE SENATE ADOPTED THE CONFERENCE COMMITTEE REPORT AND MADE IT THE ACTION OF THE SENATE.
