Amends TCA Title 16; Title 30 and Title 35, Chapter 15.
Present law generally requires the personal representative of an estate to provide notice to the beneficiaries within 60 days after entering on the administration. This bill adds requirements that: (1) Within 30 days of receipt of letters testamentary or letters of administration, an executor or administrator send to each legatee or devisee a disclosure document detailing the probate process and timeline; (2) Within 60 days after entering on the administration of an estate, personal administrator send a notice of information concerning the estate's property, creditors, and tax obligations to each legatee, devisee, and residuary distributee of the estate; (3) Within 15 days after receiving notice from the probate court that a family member or next of kin of a decedent has applied for a death certificate, the executor, administrator, or assessor notify each of the heirs listed in the probate documents; and (4) Within 45 days after receiving notice that a family member or next of kin of a decedent has applied for a death certificate, the probate court provide written notice to the appropriate executor or assessors for the estate or trust.
