Amends TCA Title 68, Chapter 104.
ON MAY 3, 2021, THE SENATE ADOPTED AMENDMENT #2 AND PASSED SENATE BILL 1111, AS AMENDED. AMENDMENT #2 rewrites the bill and adds to the present law provision regarding firework permits. Present law provides that: (1) It is unlawful for any person to manufacture, sell, offer for sale, ship or cause to be shipped or received into or within this state any item of fireworks, without first having secured the required applicable permit from the state fire marshal. Present law details the requirements for such permits; and (2) The issuance of the permits required by the present law fireworks provisions does not replace or relieve any person of state, county or municipal privilege licenses as provided by law. Before the issuance of any state and county licenses, the county clerk must require each applicant for a fireworks license to exhibit a permit or furnish other definite and satisfactory evidence that a proper permit has been issued to the applicant by the state fire marshal and that the permit is current and valid. This amendment adds a requirement that the state fire marshal verify that an applicant for a fireworks permit is locally licensed, as described in item (2) above, to do business in this state and is registered with the department of revenue prior to issuing a permit. The provisions of this amendment take effect October 1, 2021.
