SB1122112th GA (Historical)Introduced

Amends TCA Title 39, Chapter 13, Part 5.

This bill adds the offense of trafficking a person for a commercial sex act to the meaning of predatory offenses for the purposes of sentencing a person as a child sexual predator, as discussed below. Present law requires that a child sexual predator, aggravated rapist, multiple rapist, or child rapist serve the entire sentence imposed by the court undiminished by any sentence reduction credits the person may be eligible for or earn. Under present law, provisions for parole and release eligibility do not apply to the above-described offenders prior to service of the entire sentence. Neither the governor nor the board of parole may release or cause the release of such an offender in an effort to reduce prison overcrowding before completion of the full sentence. Under present law, a "child sexual predator" means a person who is convicted in this state of committing a predatory offense and who has one or more prior convictions for a predatory offense. Predatory offense means: (1) Aggravated sexual battery; (2) Statutory rape by an authority figure; (3) Sexual battery by an authority figure; (4) Solicitation of a minor to commit a sex offense; (5) Solicitation of a minor to perform sex acts; and (6) Aggravated statutory rape. This bill adds trafficking a person for a commercial sex act to the list above of predatory offenses.
