Amends TCA Title 37, Chapter 1, Part 1; Title 39, Chapter 13, Part 5 and Title 39, Chapter 17, Part 10.

Under present law, a minor commits the unruly act of illegal use of a telecommunication device if the minor: (1) Intentionally or knowingly, by use of a telecommunication device, transmits, distributes, publishes, or disseminates a photograph, video, or other material that contains a sexually explicit image of a minor; or (2) Intentionally possesses a photograph, video, or other material that contains a sexually explicit image of a minor. This bill adds that the illegal act is also committed if an image under either (1) or (2) above is an image of sexual activity involving a minor. Under present law and this bill, a minor does not violate the above if the minor: (1) Did not solicit the photograph, video, or other material; and (2) Deleted the photograph, video, or other material or reported the photograph, video, or other material to the minor's parent or legal guardian or to a school or law enforcement official.
